1. Introduction

These Terms and Conditions govern the relationship between D&V Clothing Ltd, a company registered under the Bulgarian Commercial Act with company registration number 204965452, registered address: 38 Knyaz Alexander Dondukov Blvd., Floor 3, Sofia 1000, Bulgaria, email: contact@protect-emf.com, telephone: +359 895 631911 (hereinafter referred to as the “Trader”), and the users of the online store https://protect-emf.com/ (hereinafter referred to as “Users” or “Customers”). By using the website, Customers agree to these Terms and Conditions.

Please read these Terms and Conditions carefully before using the services offered on the website.

Acceptance of these Terms and Conditions is a mandatory condition for concluding a contract between the User and the Trader.

By accepting these Terms, the User agrees that their personal data may be processed on the basis of the contractual relationship between them and the Trader.

2. Definitions

For the purposes of these Terms:

User – any natural person who purchases goods or uses services not intended for commercial or professional activity.

Terms and Conditions – these Terms, including policies on use, cookies, registration, delivery, dispute resolution, withdrawal and return forms, and all other legally relevant information published on the Website.

Personal Data – any information relating to an identifiable natural person.

Goods – tangible movable items, including water, gas and electricity when offered in limited volume or quantity.

Sales Contract – a contract under which the Trader transfers or undertakes to transfer ownership of goods to the User, and the User pays or undertakes to pay the price.

Service – any material or intellectual activity performed independently for another person.

Service Contract – a contract under which the Trader provides or undertakes to provide a service in return for payment.

Alternative Dispute Resolution Procedure – an out-of-court consumer dispute resolution procedure in accordance with applicable law.

3. Products and Prices

3.1 Product Description

The Seller offers physical products with detailed descriptions, including features, price and images. The Seller shall not be liable for discrepancies between images and the actual appearance of the products.

3.2 Prices

All prices are displayed in euros and include all applicable taxes. The applicable price is the one shown on the Website at the time of placing the order, except in cases of obvious error.

The Trader reserves the right to change prices at any time without prior notice. Such changes shall not affect orders already placed.

Discounts may be offered in accordance with Bulgarian law and the Trader’s internal rules. Discount conditions are displayed where applicable.

Different types of discounts cannot be combined for the same product or service.

If a product is returned and a refund is due, the refundable amount will reflect only the amount actually paid after any discount applied.

4. Orders and Payment

4.1 Order Procedure

Users place orders via the Website interface.

A sales contract is concluded upon confirmation of the order by the Trader.

The Trader reserves the right to refuse an order where goods are unavailable or performance is impossible.

After selecting products, the User must add them to their virtual cart, provide delivery details, choose a payment method and confirm the order.

The User will receive email confirmation that the order has been accepted.

The Trader reserves the right to refuse to contract with Users who have breached these Terms, displayed abusive behaviour, or engaged in systematic misuse.

4.2 Payment Methods

Payment methods available on the Website may include:

  • Cash
  • Cash on delivery
  • Bank transfer

If cash on delivery is selected, the User must pay both the price of the goods and the delivery cost upon receipt.

If payment involves a third-party payment provider, the User may be subject to that provider’s terms and fees.

The Trader is not responsible if a third-party payment method is unavailable for reasons beyond its control.

5. Delivery

The Customer must create an account or provide the required information to complete an order.

Confirmed orders are dispatched within up to 5 working days from confirmation.

Delivery is carried out via third-party courier services unless otherwise stated.

Delivery costs are borne by the User unless the order exceeds €80, in which case delivery is free. Delivery is free for all orders within Bulgaria.

The Trader may contact the User to confirm order or delivery details.

Upon delivery, the User or authorised recipient must sign the accompanying documents.

If delivery is refused without valid reason, the User is responsible for delivery and return costs.

The Trader is not liable for failure to deliver where incorrect or incomplete information has been provided.

The User must inspect the goods upon delivery and report any discrepancies immediately.

Risk of loss or damage passes to the User once the goods are handed over to the courier.

For international deliveries, the rules of the destination country apply. Import duties and taxes are the responsibility of the User.

6. Right of Withdrawal

The User has the right to withdraw from the contract within 14 days without giving a reason.

Full withdrawal procedures, conditions and exclusions apply as set out in the Returns Policy.

Refunds for card payments are processed to the same card within 7 working days.

7. Complaints and Guarantees

The User has the right to submit complaints regarding non-conformity.

The Trader is not responsible for:

  • Colour differences due to monitor variations;
  • Size differences up to 2 cm;
  • Normal wear and tear.

Complaints may be submitted within six months from delivery (goods) or 14 days from discovery (services).

Where a complaint is valid, the Trader will repair or replace the goods within one month.

If not resolved, the User may request a refund or price reduction.

Full complaint procedures and rights are governed by applicable consumer protection law.

8. Intellectual Property

All intellectual property rights relating to the Website content belong to the Trader or authorised licensors and are protected by law.

Users may not reproduce, distribute or modify content without explicit permission.

The Trader may suspend or restrict access to services at its discretion.

9. Personal Data Protection

The Trader processes personal data in accordance with the GDPR and Bulgarian data protection law.

Users have the right to access, correct or request deletion of their personal data.

10. Termination

The Trader may terminate the contract without notice if services are used in breach of these Terms or applicable law.

Either party may terminate the contract with one week’s notice in case of breach.

Electronic communications are deemed valid written form.

11. Severability

If any provision of these Terms is found invalid, this shall not affect the validity of the remaining provisions.

12. Amendments

The Trader will notify Users of amendments within 7 days.

If the User does not agree, they may terminate the contract within one month of notification.

Failure to object constitutes acceptance.

13. Limitation of Liability

The Seller shall not be liable for direct or indirect damages arising from use or inability to use the Website, except where required by law.

14. Applicable Law

These Terms are governed by the laws of the Republic of Bulgaria.
